TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART MARKETING AND ITS AFFILIATES AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OF SERVICE OR YOUR USE OF OR INABILITY TO USE THE SERVICE. TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU PAID DIRECTLY TO SMART MARKETING IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE, WHICHEVER IS GREATER. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
12. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or related to them or the Service will be governed by the laws of France, without regard to conflict‑of‑laws rules. The courts of Paris, France will have exclusive jurisdiction, subject to any mandatory consumer protection rules that allow you to bring claims in your country of residence.

To the extent permitted by law, you and Smart Marketing agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative action.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE OR THE SERVICE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, IT IS PERMANENTLY BARRED.
15. Waiver and Severability; Interpretation
No waiver by Smart Marketing of any term will be deemed a further or continuing waiver of such term or any other term. If any provision is held invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. Any ambiguities will not be construed against Smart Marketing.
16. Entire Agreement
These Terms of Service and our Privacy Policy are the entire agreement between you and Smart Marketing regarding the Service and supersede all prior or contemporaneous understandings.
